On January 1, 2021, the Federal Law of December 5, 2017 No. 386-FZ “On Amendments to Article 46 of the Federal Law “On Communications” and Article 1 of the Federal Law “On amendments to the Federal Law “On Communications”.

In the explanatory note to the bill we read:

“The inability to correctly identify the sender number of an SMS message hinders protection against illegal and fraudulent activities. This allows collection agencies to use unfair methods of working with clients (transmitting false information, threats, misrepresentation, etc., on behalf of insurance companies, banks and other organizations). Fraudulent actions when sending short text messages using number spoofing allow senders to avoid blocking the real numbers from which such messages are distributed, misleading the recipient of the message about the sender of the message, and also make it difficult to identify the sender of the message.”

According to the provisions of the new federal law:

  1. Telecom operators providing the transmission of short text messages (=SMS) and voice messages (=telephone calls) are required to transmit unchanged the subscriber number as well as a unique identification code) allocated to this subscriber on the basis of an agreement for the provision of communication services
  2. If violations of the requirement to transfer the subscriber number/unique identification code are detected, the telecom operator stops providing services for transmitting traffic to its communication network
  3. Telecom operators are obliged to stop providing communication services upon receipt of a corresponding request from the body carrying out operational investigative activities or instructions from the federal executive body exercising control and supervision functions in the field of the media, mass communications, information technology and communications, formed based on the results of control activities, in the event of failure to confirm within fifteen days the correspondence of the personal data of actual users with the information stated in the subscription agreements, as well as in the case of preventing and suppressing crimes using communication networks from communication means.

A few comments:

  1. From 01/01/2018, telecom operators will be required to “show” the real number of the subscriber who initiated sending a message or making a call
  2. These measures are aimed at reducing spam, fraud and illegal activities, since various methods of hiding the “real” subscriber number are very popular among spammers, scammers and attackers.
  3. Theoretically, amendments to the Law “On Communications” also apply to sending SMS messages from SIM cards registered to third parties. Now such SIM cards can be blocked in connection with requests from intelligence services or in accordance with the instructions of Roskomnadzor, if personal data is not confirmed within 15 days.

In conclusion, we note that these amendments would have been especially relevant in 2010-2013, when the situation with spam was significantly worse than it is now. Now sending SMS messages can be carried out within very strict limits and in accordance with the strict requirements of legislation and telecom operators. The situation with voice mailings is completely different, where the new law should really streamline what is happening and, finally, put things in order with voice spam.

This number gained the greatest popularity thanks to the promotion carried out by Megafon PJSC called “Happy SMS”, where the subscriber is invited to play an SMS quiz in which it is necessary to give the correct answers to questions asked by the operator.

According to the terms of the quiz, 12 rubles are withdrawn from the subscriber’s account for each day of play. In addition, if the game administrators see that the player is “hooked” on the quiz, then he is offered various paid bonuses to increase the number of game points earned.

The quiz itself takes place throughout the day in a fairly active mode. The next day, the points earned are removed, the player moves higher or lower in the player hierarchy, and everything starts all over again. How is the quiz conducted?

After the participant has subscribed to the quiz, he receives SMS messages with questions. There are 20 questions per day. The first question arrives at 11:00 (Moscow time). As soon as a participant sends an SMS to number 2216, he catches a star, it comes to him. For catching a star he gets 10 points. For every second you hold, 1 point is awarded. I have been a Tele2 client for many years, almost from the very moment they appeared on our market. But for the last couple of years, the provider has regularly “delighted” with surprises: either the connection is cut off for no apparent reason, or money is written off in an unknown direction, or they torment you with calls and SMS advertising their (and not only) services... The last straw was another increase in tariffs at... 100%. I asked around among friends and acquaintances, looked through the Internet and decided to switch to Megafon.

I wrote an application at the office, received a SIM card and began to wait for the designated day (Megafon clearly indicates the transfer date in the contract). As the office manager advised, I did not deposit the money in advance, so as not to squabble with Tele2 for it later. Since I knew that after registering the application, the current provider would pester me with calls with tempting offers, I cut off their opportunity to pester me with this question - my decision was balanced and final.

In advance, I prepared several applications to disable unnecessary services included in the package at the provider level. And on the designated day, when the new SIM card was activated, I deposited money into the account and went to the office with my statements.

The first thing the manager surprised me with was that while I was walking, the monthly fee for one of the services had already been debited from my account. Okay, I think ten rubles is not money, especially since I’m going to turn everything off now. I put my statements on the counter. Immediately the artificial politeness gives way to a grimace of irritation: “Why all this writing? We’ll just turn it off.” And really, I think, why? Turn it off and you're good. A few minutes later, the salon manager said that everything was turned off and within half an hour I would receive an SMS with confirmation. Of course, I didn’t wait for the cherished messages in the stuffy salon and went home with a feeling of accomplishment.

An hour has passed. Day passed. No messages. I go into my personal account - things are still there, or rather, services. Moreover, the money for some of them has already been written off. I click “disable” in my account. I read the message: “The service is temporarily unavailable.” Well, I'll try tomorrow. The next day another surprise awaited me: the money for the remaining services was written off. I disconnect from the account again - this time the system confirms the success of the operation and offers to wait for an SMS. As you can imagine, they never came. On the account - 12 rubles out of 150.

I quit what I’m doing and go to the office. When I ask why they didn’t turn it off, they kindly answer me: “Why didn’t they turn it off? We don't remember." I take my applications out of my bag, put them on the counter and demand that they be accepted for work and that they put a stamp of receipt on my copies with a seal and signature. Hmm, yes, I have more than once had to deal with dissatisfaction over the desire to defend my rights, but I have never encountered such an angry, disgusted look. For ten minutes they talked to me as if I were a schoolgirl, convincing me that I, an old senile girl, was fooling around and distracting honest people from their righteous labors. But, having drawn a brick on my face, I still insisted on my decision, and the statements were accepted in full. And, oh joy! A few minutes later the treasured text messages arrived.

Already at home I checked my personal account - everything is in order, everything is disabled. A couple of weeks later I go into the office again - some of the services that I disabled myself are back in operation. Turned it off. Two weeks later, history repeated itself...

Now every week I check for “self-connected” services and disable them manually. And what I turned off at the provider level (opt-out of mailing lists, telemarketing, subscriptions, Internet services, SSD advertising) is still (pah-pah) still turned off.

Yes, and one more thing: if you order call details, etc. regularly, the provider is afraid to write off money from you for nothing - he sees that you are closely monitoring the account and do not twitch. That's what I do.
