I am inclined to believe that the tragedy in Kemerovo is not the result of a random coincidence, but of systemic shortcomings in the organization of state control. According to the chief state inspector of the Russian Federation for fire supervision, Rinat Enikeev, “deficiencies in fire protection are often due to a disjointed system of state control over fire safety during the design, construction and commissioning of buildings.” I immediately remember the global changes ten years ago, when the Russian Ministry of Emergency Situations was removed from participation in fire supervision at the design and construction stage. The provisions of the bill define the principles on which state control should be based, regulate the forms of control and supervisory activities, establish lists of types of control at different levels of government, and establish guarantees for the rights of entrepreneurs when conducting control.

The bill retains the key principles of Law No. 294-FZ, but goes further, proposing additional rules that strengthen the guarantees of entrepreneurs. For example, additional grounds have been added for canceling the results of inspections and other control measures: lack of grounds for conducting an inspection, inclusion of optional requirements in the subject of supervision, non-use of checklists. At the same time, contradictions and ambiguous interpretations of mandatory requirements will be interpreted in favor of supervised persons. The range of unscheduled inspections, which can be carried out in agreement with prosecutors, has also been expanded.

It is worthy of support to consolidate the risk-based approach as the main method of control, which will reduce the number of inspections while increasing their effectiveness. The frequency, form and duration of control activities will depend on the risk category or hazard class of the legal entity or individual entrepreneur, as well as the facilities used for work. The expansion of legal opportunities for the use of remote control methods using digital technologies and special mobile applications is being designed.

But there are also disadvantages to bill No. 332053-7. No distinction is made between control and supervision, which in legal reality are not the same thing. There are many exceptions that are not covered by the law. Ineffective, redundant or duplicative requirements and procedures remain. The owner's responsibility for the condition of controlled objects is not specified, especially in terms of ensuring safety at objects with large numbers of people. The approaches to determining the lead contractor during joint inspections have not been defined. General principles for the formation of control performance indicators have not been established.

There are controversial points. In particular, documentary (desk) inspections are excluded from the scope of prosecutorial approval, while business entities experience difficulties precisely in conducting them, when they are forced to submit significant volumes of documents to control authorities. The bill establishes that inspections carried out on the grounds established by other laws are subject to coordination with the prosecutor's office in the event that such coordination is provided for by these laws. It seems that the reference rules in this matter are not fully justified, and mandatory approval would be more appropriate. It would also be reasonable to include an exhaustive list of grounds for unscheduled inspections in the basic, system-forming law, so that other laws only clarify these reasons

In general, draft federal law No. 332053-7 “On state control (supervision) and municipal control in the Russian Federation” can be assessed positively from the point of view of improving the system of state control and supervision, as well as strengthening guarantees of the rights of entrepreneurs. But it needs adjustment.
